1. Acceptance of Terms

By accessing or using PepperClaw ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

PepperClaw provides a personal AI agent accessible via WhatsApp. The Service includes account management, AI-powered responses, automations, and integrations as described on our website.

3. Eligibility

You must be at least 16 years old to use the Service. By using PepperClaw, you represent that you meet this requirement and that the information you provide is accurate.

4. Account Registration

You may sign in using a Google account. You are responsible for maintaining the security of your account and for all activity that occurs under it. Notify us immediately at legal@pepperclaw.com if you suspect unauthorized access.

5. Subscriptions and Billing

• PepperClaw offers paid subscription plans (Basic and Pro) billed monthly.
• Payments are processed by Polar.sh. By subscribing, you agree to Polar's payment terms.
• Subscriptions renew automatically unless cancelled before the renewal date.
• Refunds are handled on a case-by-case basis. Contact us within 7 days of a charge if you believe it was made in error.

6. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited messages, or harass others.
• Generate or distribute illegal, harmful, or offensive content.
• Attempt to reverse-engineer, scrape, or disrupt the Service.
• Violate any applicable laws or regulations.
• Impersonate any person or entity.

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

7. AI-Generated Content

The Service uses AI models (including Anthropic's Claude) to generate responses. AI outputs may be inaccurate, incomplete, or inappropriate. You are solely responsible for how you use AI-generated content. PepperClaw does not warrant the accuracy or reliability of any AI output.

8. Intellectual Property

The PepperClaw name, logo, website, and software are owned by PepperClaw and protected by intellectual property laws. You retain ownership of any content you provide to the Service. By using the Service, you grant us a limited license to process your content solely to provide the Service.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, PepperClaw shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if advised of the possibility of such damages. Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

11. Termination

You may cancel your subscription and close your account at any time. We may suspend or terminate your access for violation of these Terms or for any other reason with reasonable notice, except in cases of severe violations where immediate termination is warranted.

12. Governing Law

These Terms are governed by the laws of the State of Israel, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Tel Aviv, Israel.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or prominent notice on the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.
